By accessing any part of the Website, you indicate that you accept these Website Terms. If you do not agree to these Website Terms, you should leave the Website immediately, and you will be unable to order any products through the Website.

INTRODUCTION & OUR ROLE:
Company details: Damastique is a company registered in England and Wales. Our registered office is located in the heart of York.
Food Orders: We offer a platform via this website to place your orders (“Order” or “Orders”) for collection or delivery across the UK (“Restaurant” or “Restaurants”).

WEBSITE TERMS:
Website access: You may access some areas of the Website without placing an Order or registering your details with us. Most areas of the Website are accessible to everyone.

Acceptance of terms:
By accessing any part of the Website, you agree to these Website Terms. If you do not accept these terms, you should exit the Website immediately, and you will not be able to order any Products through the Website.

You are responsible for all arrangements necessary for you to have access to the Website. You are also responsible for ensuring that all persons who access the Website through your Internet connection are aware of these Website Terms and comply with them.

Capacity and age:
By placing an Order through the Website, you warrant that: You are legally capable of entering into binding contracts; and You are at least 18 years old.

ALLERGY ADVICE:
Please be aware that if you have a specific food allergy or intolerance, it is your responsibility to confirm that the food is suitable for you, by contacting the Restaurant directly before placing your order.

HOW TO MAKE AN ORDER AND HOW IT IS PROCESSED:
After selecting your desired items from our menu and providing other required details, you will have the opportunity to submit your Order by clicking or selecting the “checkout” button (or a similar button). It is your responsibility to verify all entered information and correct any errors before submitting the order; after this point, errors cannot be rectified, and you will be entering into a contract with the Restaurant.

Amending or Cancelling your order:
Once your order is submitted and payment has been authorized, you are not entitled to change or cancel your Order, nor are you entitled to a refund. If you wish to change or cancel your order, you may contact our Customer Care team as described above. We may, at our discretion, attempt to accommodate your request, but there is no guarantee that it will be possible as the order may already have been processed.

PAYMENT:
If your payment is not authorized, your order will not be processed or communicated to the Restaurant.

PROCESSING YOUR ORDER:
Upon receipt of your Order, we will send an email confirmation that your Order has been received and is being processed. Please be aware that the confirmation page and any confirmation email indicate that you have a contract for the sale of products with a Restaurant but do not guarantee that your order will be fulfilled by the Restaurant. Restaurants have the right to reject Orders for various reasons, including being too busy, weather conditions, or other reasons. If your order is rejected, we will attempt to notify you at our earliest convenience. All rejected orders will be refunded at our discretion.

DELIVERY OF YOUR ORDER:
Estimated delivery and collection times are provided by Damastique and are merely estimates. We do not guarantee that Orders will be delivered or will be available for collection within the estimated times.

PRICE AND PAYMENT:
Delivery Cost: Additional charges such as delivery fees and any administration or service charge imposed by the Restaurant may apply. These will be added to the total amount due where applicable.

Card payments:
If you choose to pay by credit or debit card, you may be asked to show the card at the time of delivery or collection as proof of identification and to verify that the card matches the receipt details for the Order.

Credit/Promotional Discount Codes: A credit or promotional discount may apply to your Order if you use a promotional voucher or code recognized by the Website and endorsed by Damastique, and you pay for any balance by credit or debit card. The credit or discount will be applied at the time your bank or card issuer processes the transaction, at which point the credit or discounted amount will not be transferred to us and will instead be released by your bank or card issuer back into your available balance. You acknowledge and agree that neither we nor the Restaurant will be responsible or liable to you concerning this delay by your bank or card issuer in the release of funds back into your account.

CUSTOMER SERVICE:
If your order is taking longer than expected, or you have any other issues with your Order, you can contact our restaurant, and we will endeavor to address your concerns.

If you wish to change or cancel your Order after it has been submitted and payment has been authorized, you may contact our restaurant as described above, and they will attempt to accommodate your request. However, there is no guarantee that we will be able to act on your request as your Order may already have begun processing.

If you are dissatisfied with the quality of any Products or the service provided by Damastique and wish to seek a refund, a price reduction, or any other compensation, you should contact the Restaurant directly to lodge your complaint and, where appropriate, follow Damastique’s complaint procedures.

Terms of permitted use: You are allowed to use the website and print and download extracts from the Website for your personal, non-commercial use on the following basis:

Unless otherwise stated, the copyright and other intellectual property rights in the Website and in the material published on it are owned by us or our licensors.
